La Ruta de las Cascadas – Baños, Ecuador

You can rent a bike in Baños, Ecuador to cycle the route that takes you along the mountains and valleys where numerous waterfalls are located. A majority have tarabitas that you can ride from $1-1.50 USD to get really close to the falls, or to a bridge where you can walk to the waterfalls or even hike. Definitely worth a few hours of your time. Especially the end, where you can see the powerful Pailon del Diablo.

I have been waiting 2 weeks for major leaks and ceiling repairs and rent is due…?

almost 2 weeks ago we had a massive amount of rain here in maine and I had a varitable waterfall in my kitchen in the same spot I had had a small leak about a year ago. Last years leak was caused by a roof drain that wasn’t properly cleared of debris after the autum season, and low and behold that turns out to be the reason for my current situation. I notified my landlord promptly (it began at 2am, I called her at 8am). I lost work hours waiting for maitenance to arrive, and they proceeded to cut the wet and hanging drywall from the cieling, and lie down a plastic sheet. It was no small leak (from 2am to 8am it poured about 7 gallons in to my various buckets). They cut a 4 foot by 9 foot section out, and told me they couldn’t do any repairs until the insulation had dried. It’s now almost 2 weeks later, the dripping had finally stopped, but the insulation is still damp and maintenance hasn’t even been back to check, though I have called multiple times. In my opinion the leak wouldn’t have happened had the landlord not been neglegent in maintaining the drainage system, and it has rendered 1/3 of my apartment unusable. Rent is due, and I attempted to contact her regarding a reduction in my payment. She said she would reimburse me 100 for loss of 50lbs of dog food that got drenched in insulation water, and for loss of work. I’m not looking for a free ride, have been an ideal tenant and haven’t once in 5 years ever been late on a rental payment, but I feel taken advantage of, and having been stuck cleaning up after a mess that was no fault of my own and in fact due to the owners neglegence and living in an unsafe and partially uninhabitable dwelling I feel an adjustment should be made. I made it clear that I have no problem paying for the sections of the apartment that are usable, and determined by square footage a daily rate concurrant with my rent payment that I believe should be deducted for every day I go without the complete use of my kitchen.what do I do?

At best, you would have to sue your landlord in small claims court to get a settlement. However, if you have been there five years, and are the quality tenant you claim to be, you have a great bargaining chip.
Document your losses and place a fair amount on those losses. Approach your landlord and explain your request for compensation. If the landlord wants to keep you, he/she should be more than willing to work with you toward a fair resolution. Be receptive to compromise though, or you may end up with nothing!

Sopping wet insulation in my kitchen, and landlord just wants to let it dry…?

Now, just to be clear, I love my apartment and generally speaking my landlord is great. I always pay my rent on time, and have been in my apartment for 4 years now with no issues aside from what I’m about vent about, as I’m not sure how to approach this at all. Last winter, during a mid winter melt (i live in Maine) I had some minor leaking and blistering of some paint in my kitchen, which my landlord said was due to a clogged roof drain in combination with an ice dam. The drain was fixed, and the problem was fine. Until 3 days ago, during a rain storm I was woken up to a waterfall in my kitchen. Apparently about 8" of water had gathered in the attic and was draining in to my apt. Landlord sent over a handyman to unclog the same drain that had issues last year. He also cut out about an 8 x 12 foot section of cieling…..almost my entire kitchen….to let it drain. We are expecting more heavy rain this weekend, and the landlord has said that she doesn’t want to repair anything before the storm in case the drain wasn’t the issue. I understand things happen and all, but now I’m stuck with a gaping ceilimg with gross attic nasty water dripping everywhere, and sopping insulation hanging. I can’t go anywhere near the kitchen without getting splashed on, and it’s leaking about 3gl of water every 24 hours. She also said that if it IS just the drain that I would have to just wait a couple weeks for the insulation to dry before they could drywall the kitchen. Is that safe?! Shouldn’t they get fans or a dehumidifier in to the attic or something? I can’t live like this for weeks….its just gross and it smells horrible. I also have 2 dogs, but thank goodness the plastic sheeting on the floor bothers them so they don’t go near the area. What are my rights as a tenant? How should I approach this? I’m not looking to whine or complain, but this is just a bit too much. Should I insist the insulation be replaced? Not sure what to do. Please help!
just a note for the first man that answered. An ‘act of God’ denotes a natural disaster, I.e. A hurricane, tree falling through the roof, or a tornado. NOT a neglected drain or an ice dam. Thank you everyone for your responses. I really appreciate it.

Your landlord is doing everything right it may be an inconvenience but it is the proper way to do it. Imagine if he were to repair it now and then have to do it over and over again because he did it too fast and never let it dry. If you were the owner and called a repair company it would probably get done in the same time frame that he is working on. It is a inconvenience but but he is working on it and it will be fixed soon. This falls under an act of god and so doing there is no recourse as long as the owner is attempting to fix the problem
